Paula Padilha, partner from Energy & Natural Resources: Power and Infrastructure area, speaks to BNamericas about the new Brazilian Provisional Measure (MP), introduced as part of the ongoing power sector reform. The MP aims to support the containment of energy tariffs by establishing a revenue cap for the Energy Development Account (CDE), as well as creating a new compensatory charge to ensure that the CDE does not exceed the stipulated limit.
For Paula, the new Provisional Measure raises some concerns, such as the possibility of creating a new form of indirect taxation: “This measure could represent a significant financial impact and compromise medium and long-term planning for many stakeholders”, she comments.
