ANP opens public consultation on the criteria for autonomy and independence of gas carriers
On October 19th, 2020, ANP published its Public Consultation nº 18/2020 about the resolution that will establish the rules for independence and autonomy of natural gas carriers, as well as the procedure for certification of independence, which shall be observed by such carriers.
The public consultation will be open for contributions for 45 days and the public hearing is scheduled for January 26th, 2021, by videoconference.
The independence and autonomy of natural gas carriers are part of the New Gas Market federal program, which shall observe the guidelines of CNPE Resolution nº 16/2019 of art. 5 of the New Gas Law (Bill nº 6407/13), and is one of several steps in the complete unbundling of the gas transport industry. Currently, the referred Bill is under analysis by the Senate under nº 4476/2020.
This is the first in a series of new resolutions and revisions of existing legal provisions provided for in the ANP's Regulatory Agenda for the biennium 2020-21.
The draft resolution addresses the following points:
- Criteria for autonomy and independence of natural gas carriers;
- Criteria for independent operation of the transport activity, in cases where the carrier chooses to transfer the operation of its transport assets to an independent operator;
- Procedures to be adopted to obtain carrier independence certification from ANP; and
- Criteria and form of adaptation to the rules of unbundling by carriers.
