Commission dedicated to mines and energy of the house of representatives discusses New Gas Law
On August 27th, 2019, the Commission dedicated to Mines and Energy of the House of Representatives held the public hearing to discuss the Bill of Law No. 6.407/2013 that will amend the Gas Law.
The purpose of the hearing was to present the work being done to open the Gas Market, the prospects and the demands of the main players of the sector:
- National Petroleum, Natural Gas and Bio-fuels Agency – ANP;
- Ministry of Mines and Energy – MME;
- Administrative Council of Economic Defense – CADE;
- PETROBRAS;
- Brazilian Association of Gas Distributors’ Companies – ABEGÁS;
- Brazilian Association of the Major Industrial Consumers of Energy and Free Consumers – ABRACE;
- Brazilian Association of Gas Transportation Companies – ATGÁS;
- Brazilian Institute of Petroleum, Gas and Biofuels – IBP;
- National Confederation of Industry – CNI;
- Brazilian Association of Electric Energy Sales Agents – ABRACEEL; and
- Brazilian Chemical Industry Association – ABIQUIM.
Among the topics addressed during the hearing as essential for the effective development of the Gas Market, we outline the following:
- Strengthening the Free Consumer figure for the promotion of the Brazilian Industry;
- The development of regulation of the natural monopoly and the constitutional monopoly of Natural Gas to promote clear standards for the sector;
- Implementation of the competitive model for the Gas sector, through the Entry and Exit system, which will begin to be pioneered by TBG;
- Free access to infrastructure by various industry players;
- The unbundling of the sector;
- Complete separation of the chain of activities (production, transportation, distribution and trading);
- Tax reform to allow new tax treatment for the sector;
- Change in the granting regime for the authorization regime, in order to enable natural gas transportation and storage projects;
- Self-Dealing seal (sale between related parties);
- Provision of Gas Release and Capacity Release programs;
- Free Prices.
