The Government of São Paulo publishes a decree related to the classification criteria of piped gas distribution pipelines
The Government of the State of São Paulo published on July 28th, 2021, the Decree nº 65,889 that establishes the classification criteria to be applicable to the piped gas distribution pipelines in the sphere of the state of São Paulo.
Under the decree, as per the provision of §2º of the Article 25 of the Federal Constitution, the facilities for local piped gas services for the users, captives or free, of any segment, located at the state of São Paulo, are classified as distribution pipelines through:
I – Gas handling;
II – Interconnection to transportation pipeline;
III – Direct connection to:
- Production flow pipeline;
- Compressed natural gas (CNG) or liquefied natural gas (LNG) terminals;
- Pipeline that is part of the flow facilities;
- Stocking, processing and natural gas treatment facilities;
- Biomethane and biogas plants.
Additionally, it was attributed to the Regulatory Agency of Public Services of São Paulo (Arsesp) competence to classify as distribution pipelines the facilities located in the state of São Paulo, considered of interest to the gas piped local services rendered by the state gas distributors, and part of the Regulatory Remuneration Base approved in the process of tariff review.
