DPC reviews NORMAM about Ballast Water Management
On September 1st, 2022, comes into effect Ordinance No. 59/2022, published by the Directorate of Ports and Coasts (DPC) on August 19th, 2022, which approved the 1st Amendment to NORMAM-20 (Maritime Authority Rules on Water Pollution caused by Vessels, Platforms, and their Support Facilities - 3rd Revision). The changes are limited to the NORMAM’s chapter 2, which regulates the ballast water management.
Except for vessels used in river navigation, NORMAM exempts other Brazilian-flagged vessels from Ballast Water Management while operating in Brazilian waters (AJB).
Foreign-flagged vessels operating in AJB with a Temporary Enrollment Certificate (AIT) are also exempt from ballast water management, however, after due verification of the Ballast Water documentation, according to item 2.1.3 of NORMAM.
Pursuant to the NORMAM, Maritime Authority Agents must be informed about ballast water exchange operations in emergency situations, that is, when the ballast water management cannot be carried out due to unforeseen situations.
Finally, NORMAM started to require that all companies subject to Ballast Water Management have the documentation related to Ballast Water, as per item 2.2.1 of NORMAM.
