Ministry of Environment publishes Ordinance to regulate the Waste Transport Manifest and the National Solid Waste Inventory
On June 30th, 2020, the Ministry of the Environment had its Ordinance Nº 280, which created the Waste Transport Manifest (“MTR”) and the National Solid Waste Inventory, published on the Official Gazette of the Union.
According to the Ordinance, the solid waste generators subject to the elaboration of the Solid Waste Management Plan (“PGRS”) must register the handling of their waste in the MTR, applicable to all members of the chain (generator, conveyor, temporary storage, if applicable, and the final receiver) the obligation to certify, successively, the generation, storage, transport and receipt of solid waste until its environmentally adequate final destination.
Waste Transport Manifest – MTR is a self-declared document, generated through the National System of Information on Solid Waste Management (“SINIR”), valid throughout the national territory, which must follow the transport of the waste from its source to its final destination.
The ordinance also regulates MTR Import and MTR Export documents that must be issued to follow, respectively, the transportation of waste from the point of entry into the country to the importer (generator), and the waste transportation from the generation site to the point of departure for export.
It is the generator's responsibility to make sure that the conveyor and the receiver are adequate and regularized for the execution of the transport and destination service, respectively, in accordance with the current regulations.
The waste generators must report additional information to those already declared in the MTR, referring to the previous year, by elaboration and filing before the National Solid Waste Inventory here.
The MTR and the National Solid Waste Inventory will be available for trial period from the publication date of the ordinance until December 31st , 2020, through the website mtr.sinir.gov.br and inventario.sinir.gov.br, becoming mandatory on January 1st, 2021.
